The State of California issued another statewide two-year extension (AB208) to valid subdivision maps (Tentative and Vesting Tentative Maps). Extensions to other City approvals are simultaneously granted. As a result, the new expiration date for the Village at Loch Lomond Marina is now August 20, 2014.

Also, at this time, no progress has been made regarding the issues detailed in the May 1, 2011 entry below and there is also no change in the status of the sale of the property as discussed in the entry below dated July 20, 2010.

In 1998, complaints were brought to the Marina about lighting that had been installed in the parking areas of the Marina without a permit. In 1999, a permit was issued to install new lighting that would resolve the issues of light pollution into the Chicken Point area of Bayside Acres subdivision and the lower areas of Loch Lomond. This permit was set aside and lapsed when plans were being developed for the Village at Loch Lomond Marina PUD. At this time, those plans are in abeyance and there is no date at which they may begin that development. Several residents of Bayside Acres have had to endure light pollution for over a decade as a result. It is the Coalition’s position that the Marina should conduct a remediation of that continuing light pollution problem. The full extent of the original lighting plan is not required since a larger construction effort is in the wings. However, some work should be done to alleviate the problem in the interim.

As part of the Village at Loch Lomond Marina plans, an area containing wetlands was set aside as a conservation zone that is to be protected and remain in a natural state. Those plans included barriers and other methods to accomplish that objective. Again, since the plans are in abeyance, no such work was initiated. In the past year, there have been occasions in which significant damage has occurred in the wetlands area, some by visitors and some by the Marina operators. The Coalition believes that the owners of the Marina property are under an obligation to protect the conservation area even prior to the start of construction. The Coalition urges the City and the Marina to identify and execute actions to be taken to protect the conservation area, including installation of barriers and other protective procedures to be taken by the Marina operators.
