Several status items regarding the Marina development:

  1. The developers are moving forward to start the surcharge process. A first draft of the grading plans was prepared for the City, but it was incomplete. The developers now need to revise their surcharge plans in order to submit a more complete version. At present, there is no short-term schedule on this activity.

  2. Draft subdivision improvement plans have been prepared and submitted for the first Final Map. The Public Works Department has reviewed them and pointed out a number of corrections that need to be made. As in the case with the surcharge plans, the comments have been forwarded to the developer and there is no immediate schedule for a re-submittal.

  3. The City has had a number of meetings with the developer regarding the formation process for the Mello-Roos District. The Mello-Roos District is required to ensure long-term funding of the shoreline park, marina green improvements and the seasonal wetland at the east end of the property. Detailed cost estimates and the appropriate formation documents have been prepared and the City will be meeting with the developer and attorneys before the end of this month to discuss. A public hearing to form this district will probably be held in March-April.

  4. The final landscape plans for the shoreline park and marina green have been completed and submitted. Per the conditions of approval, the final plans must go to the City's Park and Recreation Commission for approval. The Commission review is required to confirm that the conditions have been met. Since there can be no changes to the previously approved plans, just more details, no public hearing is required and there will not be a formal noticing to neighbors. This review will probably take place at the February 18th meeting of the Park and Recreation Commission. Persons interested in attending the review meeting, can check with the City to see if this review is on the agenda for February 18th.

  5. Harbormaster Pat Lopez has reported that he is about to submit additional information requested by BCDC concerning the needed repair at the end of the boardwalk. He expects the work to be completed soon.
January 15, 2010 The application filed with BCDC in August 2009 to do repair work to the area at the end of the waterfront walkway where the rip rap is failing is not complete. When the application was filed, BCDC requested additional information so they could proceed with processing, but the additional material has not yet been provided by the Marina property owner, Oaktree Capital.
January 9, 2010 The San Raphael Public Works Department is processing street improvement plans for the Village at Loch Lomond Marina project, a required step in the process. As yet, no plans for the surcharge schedule have been submitted.
October 2, 2009 On Monday, October 5, the S.F. City Council agenda includes an item dealing with the establishment of the Mello-Roos tax district for the Village at Loch Lomond Marina project. This tax district is to fund the support for the public access portions of that project. For more information on this agenda item, read the S.R. City Council Agenda Report.
August 23, 2009 A section of the waterfront walkway at the marina near the point that the breakwater begins had been closed off by orange safety fencing. The walkway was undermined by erosion. An application was filed with BCDC to effect the repair work. Meanwhile, the boardwalk and the bench are open for public use.
August 5, 2009 State legislation (AB333), which has been signed by the governor, automatically gives a two-year extension to currently approved projects with valid maps. For the Marina project, this extends approvals to August 2012. Meanwhile, the owners have put this development on hold pending improved economic conditions. They are also looking to sell the property along with the entitlements to build the project.

The LLMOC is maintaining monthly contact with the City of San Rafael for updates on anything happening concerning the marina. Although the new developers obtained some information from the City on setting up the Mello-Roos Assessment District (a tax mechanism on properties within the development to maintain the public areas as required by their permits), they have not gotten back to the City with any steps to implement it or to file for permits to begin grading/fill work.

Meanwhile, the Committee has concerns about the state of the re-planting done last year to repair damage to then-existing planting at the rear of Andy's Grocery in violation of the permits. At least one of the trees appears to have subsequently died. We also have concerns regarding the support for maintaining the existing facilities, especially the grocery, by the current owners of the property while development is delayed. We will be in contact with the City on these matters.

March 27, 2009 Thompson/Dorfman of Sausalito, the company that has been acting as local developer and processors for Oaktree Capital (owner of the Marina property) has been replaced by Real Estate Strategies and Solutions, Inc., a company headquartered in Emeryville. Todd Wright and Dan McNevin of Real Estate Strategies and Solutions, Inc. have told the City that they plan to carrying out fill and grading at the Marina site during this year.
