The Village at Loch Lomond Marina – Who’s Who

Owners

The following are the five entities that are owners of property, parcels and easements within The Village at Loch Lomond Marina. Other non-owner entities having some form of responsibility within The Village at Loch Lomond Marina are listed in the next section.

The Village at Loch Lomond Marina Master Association, Inc. (“Village Association”): Owns several parcels, all with public access easements, consisting of the wetlands, Loch Lomond Drive with street parking, Marina Green with boardwalk, marina plaza next to Andy’s Local Market, east jetty (playground) and west jetty. Maintenance costs fall under the CFD with San Rafael oversight (once accepted by S.R. agencies) as well as under the purview of BCDC. The Village Association membership consists of SHM, Strand HOA, Andy & Troy Bachich, and Trumark Homes (while they retain ownership of the residential parcels under development). Each member holds differing numbers of votes with the Strand HOA holding the largest voting block.

The Strand Community Association, Inc. (“Strand HOA”): A homeowners’ association (HOA) consisting of privately-owned residential parcels and common area lots and access easements within the residential area of The Village at Loch Lomond Marina. The Strand HOA is responsible for the common area lots and easements including Bayharbor Way, auto courts and walkways as well as landscaping. The walkways running between Point San Pedro Road and the marina green passing through the Strand HOA are included in the public access easements, but the auto courts are not.

Safe Harbor Marinas Loch Lomond (SHM): Owns the breakwater, breakwater access trail or BAT (both of which have public access easements), marina piers and fuel dock, yacht club building, Harbormaster’s Office parcel, boat launch ramp with related access pavement, boat repair building parcel, marina parking lot at the west side of the development and the fuel storage parcel. Much of this property is also under the purview of BCDC. Surface maintenance of the breakwater and breakwater connector falls under the CFD, but certain essential liabilities remain with SHM. Andy & Troy Bachich (Andy’s Local Market): Owners of the parcel containing Andy’s Local Market and adjacent parking. In early 2023, Andy also purchased ownership from MVA of the parcels consisting of Lot 2 at the corner of Loch Lomond Drive and Pt. San Pedro Road (containing the abandoned commercial building) and the adjacent Lot E which is currently vacant and approved by permit to be a parking area.

Trumark Homes: A residential developer, Trumark owned the undeveloped and unsold residential parcels within The Strand residential subdivision with related parking. These parcels are required to be included within The Strand HOA once they are developed and sold. The Trumark Homes website includes a section for The Strand at Loch Lomond Marina which describes the parcels and related marketing and sales information. This development is very near full completion, with all parcels incorporated within The Strand and Trumark Homes ending its relationship with this development.

Non-Owner Entities

The following are most of the non-owner entities that are involved the development or maintenance of The Village at Loch Lomond Marina.

Mello-Roos Community Facilities District (CFD): Special taxing district established as a means of obtaining funding for a specific purpose. For example, it is this type of CFD that collects tax funding for maintenance of the medians on Point San Pedro Road from the properties along the roadway. In this case, this CFD is a taxing district charged with collect funds from property owners within The Village at Loch Lomond Marina to finance the maintenance of those properties having public access easements as well as repair and upkeep to the community infrastructure (utilities, roads, etc.).

Public Access Easements: Those parcels within The Village at Loch Lomond Marina which are privately owned by the respective entities described below but which are encumbered with public access rights under their title and ownership covenants as required by San Rafael and BCDC.

S.F. Bay Conservation & Development Commission (BCDC): A California governmental agency charged with protecting and enhancing San Francisco Bay and encouraging the Bay’s responsible and productive use for this and future generations including any requirements for public access. It has jurisdiction over the waterfront area of The Village at Loch Lomond Marina.

San Rafael Community Development Department (CDD): The CDD is the agency tasked with, among other responsibilities, processing development permits in a timely manner and ensure that new construction is an asset to its surroundings. As such, all building development plans, permit approvals and building code enforcement fall under CDD’s jurisdiction.

San Rafael Department of Public Works (DPW): The DPW is the agency tasked with approving plans and issuing permits that deal with infrastructure development. That includes utilities, roads, parks, wetlands, public spaces, etc.

S.F. Bay Regional Water Quality Control Board (RWQCB): The S.F. Bay RWQCB, one of nine throughout the State, is chartered to preserve, enhance, and restore the quality of the Bay’s water resources and to ensure proper water resource allocation and efficient use. As such, any activity that might impact the S.F. Bay requires clearance by the RWQCB.

Marina Village Associates (MVA): MVA was previously the sole owner of The Village at Loch Lomond Marina development but has sold all of its ownership over the recent years. MVA retains responsibility for some remaining development obligations within certain public access easement parcels including those covered by the governing BCDC permit and a list of “to-do” items (called the “punch list”) created and maintained by the San Rafael Dept. of Public Works (DPW). This primarily includes the flood mitigation work on the Breakwater Access Trail (BAT) which connects the parking area to the marina breakwater and on the east jetty which contains the playground. It also includes some remaining obligations within a portion to The Strand yet to be completed.

Army Corp of Engineers (ACOE): The ACOE is responsible for America’s waterways, including the S.F. Bay. Any construction activity that impacts the Bay requires ACOE clearance.

Other Entities: Various other agencies and companies are involved in a development such as this one, including the Marin Sanitary District, Marin Municipal Water District (MMWD), PG&E, and others.
